Arizona Divorce Cost

A litigated divorce in Arizona can cost as much as a new car for each party. It is not out of the ordinary to spend over $10,000.00 in lawyer fess in just six

months of litigation. Typically Arizona Divorce Attorneys charge anywhere between $250 and $350 per hour. Your lawyer will probably charge you for everything including phone calls, emails, drafting letters, pleadings and Court appearances.

A large number of litigated divorces will also require experts. Experts may include mental health, custody evaluators, business experts, real estate appraisers and accountants. One party may also have to pay for a portion of the other party’s attorney and experts costs if the Court finds that such an award is appropriate based on a disparity in income between the parties. Other fees associated in an AZ divorce would include deposition transcripts, legal research, copies, faxes, deliveries, witness fees, subpoenas, and many other costs. There are also fees to file with the court on top of everything else.

A contested divorce in Arizona may look like this:

Husband                    Wife

Attorney’s Fees                                           $20,000.00                $20,000.00

Custody Evaluator                                    $4,000.00                   $4,000.00

Business Appraiser                                                                           $15,000.00

Forensic Accountant                               $5,000.00

Costs                                                             $1,500.00                    $1,500.00

The total combined expense for all of this: over $70,000

You can buy a pretty nice car for $70,000. I think the money would be better spent on the children’s college education. The alternative to the stress and expense of a contentious divorce is mediation. Mediation in Arizona can be used to settle the most difficult and complex of cases. In mediation, the parties will choose a neutral party to assist them in resolving all of the issues and submit all of the necessary paperwork to the Court.

A typical Arizona Divorce Mediation can cost under $2000 which includes the $577 of Court filing fees. You can still use an attorney if you are using a mediator. You can even agree to have your attorney at the mediation. Even with attorneys involved in the mediation you will still end up spending a fraction of what a litigated case would cost.

Many people just start with an attorney because they do not know that other options exist. It is unfortunate that the field of mediation is not better understood by those that are getting divorced. Mediation could truly provide a great service to people. The goal of this website it to train and educate the public about mediation and its benefits.
